Terms of Use

V2C PARTNERS LLP welcomes you to our service. The Service is supplied to you on these terms. To activate your account, read through the Terms, close this window and return to the registration page. To proceed and activate your account, you must indicate your acceptance of these Terms by ticking the associated checkbox on the registration page.

Services and Products

Service and products are owned and operated by V2C PARTNERS LLP. We aim to provide you with a range of hosted, web-based applications, incorporated in a portal or on a standalone basis. We do not monitor, edit or disclose your messages or data content unless required by law. You use these services and products at your own risk.

We plan to progressively improve and upgrade our services and products and will provide you with notification of any changes 30 days in advance of these being released.

Service Levels

We expect to maintain industry standard service levels on our services and target 99.5% availability on all our services. We also target 90% adherence each month to our service response targets.

We operate an anti-spam policy and a privacy policy and are registered under the data protection act.

Your responsibility

You are responsible for the content of your messages and your data. You must comply with all regulations, policies and procedures of networks connected to the Service (including Internet specific regulations, policies and procedures). You are responsible for the client environment accessing the hosted services, including hardware, telecoms and other software used.

You cannot resell the Service without our written permission. You cannot use the Service for chain letters, junk mail, spamming or any use of distribution lists to anyone who has not given you specific permission to do so. You must not send, store on or post to the Service any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material. You must not transmit or upload material that encourages conduct that could be a criminal offence, result in civil liability or otherwise violate any relevant law or regulation. You must not use the System to attempt to gain access to other computer systems. You must not interfere with any other person's or entity's use or enjoyment of the Service.

Administration of Postmaster
All site administration is managed by V2C PARTNERS LLP. You are responsible for keeping your password confidential, and for any activities occurring in your account or under your password. You must establish and maintain proper security measures and procedures to provide for the safe custody of your username and password and to prevent unauthorized access to or use of the materials and/or any data available through the Service. You may change your password or set up or close an account at any time by following instructions given in the Service. You must immediately notify us of any unauthorized use of your account or any other breach of security which you know about on our support site: support@postmaster.co.uk

You must maintain accurate and complete registration data about yourself as prompted by the service and maintain this to ensure we have correct contact details for you. We reserve the right to terminate the service should this data become out of date. We have implemented secure procedures to protect this confidential data and to prevent alteration, unauthorised disclosure, or accidental or unlawful destruction.

Indemnity
You agree to indemnify and hold V2C PARTNERS LLP and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

 

No Resale of Service
You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

Terms of Contract
All products and services are sold based on 1 year license agreements. Continuing use of our products and services is contingent on payment being made on the annual renewal date. Should you fail to renew your license we reserve the right to disable your access to all software, data and messages stored within our hosted environment and we have no obligation to forward any unread, unsent or stored messages or data.

Payment
All fees are due in advance of the license year.

Payment Methods
All online payment transactions are by credit card and are operated via a secure server through the WorldPay service. We accept the following cards: Visa, MasterCard, Switch, American Express, JCB, Diners, Laser, and Electron. All transactions are subject to validation checks. All fees and payments are non-refundable.

Our rights in content
The content of all V2C PARTNERS LLP portals is protected by intellectual property rights and laws. This content includes text, software, music, sound, photographs, video, graphics and other material contained in or distributed in the Service. You may only use this content in ways expressly authorised by us or by the relevant advertiser.

Modifications to the Service
V2C PARTNERS LLP reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that V2C PARTNERS LLP shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Termination of the Service
You agree that V2C PARTNERS LLP may, under certain circumstances and without prior notice, immediately terminate your account, any associated email address, and access to the Service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of the TOC or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Termination of your Postmaster account includes (a) removal of access to all offerings within the Service (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in V2C PARTNERS LLP's sole discretion and that V2C PARTNERS LLP shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Service.

Privacy Policy

Postmaster respects the privacy of its members and takes its responsibilities regarding the security of your customer information very seriously. Postmaster is committed to providing you with a professional, valuable and personalised service whilst safeguarding your privacy. This Privacy Policy explains how Postmaster use your personal data. This information will assist you to determine whether or not to provide your personal data to Postmaster.

Postmaster may update this Privacy Policy from time to time. We will notify members of all material changes through the Postmaster.co.uk website.

What is personal data?
Personal data is any information that allows you to be identified. The types of personal data Postmaster will collect may include details of your name, address, telephone number, email address, fax number and date of birth.

How does Postmaster use personal data?
Postmaster will use your personal data where it is necessary to do so because it is relevant to Postmaster's dealings with you including for billing, customer service and network management.

Postmaster does not share your details with its third party partners; if you choose to do so yourself through, for example, an advertisement or promotion featured on the Postmaster website, then that is a matter between you and that third party and is subject to their Privacy Policy. If you have consented to receive third party direct marketing you will need to unsubscribe directly with that third party.

Postmaster will only use your personal data in a way that is fair and lawful taking into account your consent, the extent to which it is necessary for Postmaster to use your personal data in its dealings with you and the purposes which are disclosed to you in this Privacy Policy or which are relevant to the reason for your giving your personal data to us. Postmaster will not sell, trade or rent your personal information to others.

Under the provisions of the UK's Data Protection Act and as required by law, Postmaster may be compelled to disclose a member's data to a law enforcement agency in connection with an investigation. In these cases, the law enforcement agency is required to provide Postmaster with a duly authorised Data Protection Release form which obliges Postmaster to disclose the information to that agency and its named nominees.

Use of "cookies"
Postmaster uses "cookies" on its website(s). The "cookies" contains information related to and essential to your user session on the Postmaster website.

Security of your personal data
Postmaster has in place appropriate technical and organisational security measures to prevent unauthorised or unlawful disclosure of, access to, accidental or unlawful loss or destruction of, or access, alteration or unauthorised disclosure of your personal data. These measures ensure an appropriate level of security in relation to the risks inherent in the processing and the nature of the personal data to be protected. Your securely held personal data will only be accessible by select authorised members of staff within Postmaster.

Your rights to your personal data held by Postmaster
Postmaster will only keep your information for as long as we are either required to by law, or as is relevant for the purposes for which it was collected.

Anti-Spam Policy

Postmaster specifically does not authorise the use of its computers, servers, routers, network and software (the "Service") to accept, transmit or distribute unsolicited bulk e-mail. It is also a violation of Postmaster policy, and the law, to send or cause to be sent email that makes use of or contains invalid or forged headers or other means of deceptive addressing. Email sent or caused to be sent from the Postmaster Network that violates the Terms & Conditions is also unauthorised. Further, Postmaster does NOT permit the harvesting or collection of usernames or email addresses from the Postmaster website for any purpose including sending unsolicited email. Any such action constitutes a violation of Postmaster policy.

Postmaster reserves the right to take all legal and technical steps available to prevent unsolicited bulk email or other unauthorised email from entering, utilising or remaining within the Service. Such action may include, without limitation, the use of filters or other network devices, immediate termination of the Service, and prosecution of offenders through criminal or civil proceedings. Nothing in this policy shall be construed to grant any right to transmit or send email to or through the Service, and in no event shall any failure by Postmaster to enforce this policy constitute a waiver of Postmaster's rights.

To report breaches of the Postmaster Anti-Spam Policy to support@postmaster.co.uk. Please make sure to include complete headers of the suspect email.

Acceptable Use Policy

Postmaster reserves the right to change this AUP at its sole discretion and without prior notice. Any decision made by Postmaster in relation to this service will be final on all matters.

Exchanging email and publishing content online, including images, text and other media, is generally a matter of common sense and courtesy to others. The vast majority of Postmaster customers will be able to use their own sense of what is appropriate to guide their behaviour when using our service and will have no problem in conforming to this AUP as well as international copyright laws.

Regrettably, from time to time, emails are sent and content is published that is either considered unacceptable by other members of the Internet community or is in breach of copyright or other legal statutes. This is usually described by the generic term of "abuse".

Postmaster's AUP does not permit members to use the Service for chain letters, junk mail, spamming or any use of distribution lists to anyone who has not given you specific permission to do so; to send through, store on or post to the Service any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material. to transmit or upload material that encourages conduct that could be a criminal offence, result in civil liability or otherwise violate any relevant law or regulation; to use the System to attempt to gain access to other computer systems; or to in any way use the Service to interfere with any other person's or entity's use or enjoyment of the Service or the Internet at large.

It is not always obvious whether such activity is innocent, inadvertent, or intentional. However, certain activities will result in action being taken by Postmaster as described below.

Postmaster will enforce appropriate sanctions against any of its customers who are responsible for serious "abuse". Such sanctions may include, but are not limited to, a formal warning, suspension of Service access, termination of the customer's account(s) and/or website(s) or, in the case of criminal acts, reporting the customer to the appropriate authorities for prosecution.

If an account suspension is imposed, then this may be lifted solely at Postmaster's discretion, upon receipt of a formal written undertaking not to commit any future "abuse". All cases are considered individually upon their merits.

If you choose a link to a website outside Postmaster please be aware that it is an external site and, therefore, Postmaster neither manages nor maintains it and is not responsible for its content or operation. Whilst every effort has been made to ensure the quality of all websites linked with Postmaster, we are not responsible for material contained on those sites.

You might correspond with organisations or individuals advertising their products or services on Postmaster. Any correspondence, transactions, and terms relating to your dealings with advertisers are solely between you and the advertiser. You maintain rights, responsibilities and sole legal liability for any content, information or materials you upload, store or post on Postmaster.
